The process by which choices are made for survival does not inherently involve "cognitive" functions of AI constructs such as LLM (Large Language Models).

Each time we anthropomorphize it like telling it has "cognitive" functions, we are being ignorant to the fact, and are entering into dangers. As some of stupid politicians will start running LLMs against us citizen to profile us and label us as citizen.

Yes, if he was using llama license, now he cannot change the license. It is maybe better using other models like Phi-3.5 from Microsoft licensed under MIT license, fully free software, there is Mistral and others who even outperform llama, which are free software
